FAQs

When must I update/amend the RCBE declaration?

Whenever there is a relevant change to the company’s or beneficial owner’s information.

Is there a deadline for the update?

Yes, within 30 days from the event resulting in the change to the company’s or beneficial owner’s information.

What happens if no update/amendment is made?

Should the entity fail to submit the updated/amended RCBE declaration, it is barred from:
  • Paying out profits or interim profits to shareholders.
  • Executing or renewing contracts with the State (supplies, works, procurement of goods/services) and tendering for public utility concessions.
  • Accessing public or European funds.
  • Executing deeds for/sale and purchase of real property.
In addition to these restrictions, failure to comply can be publicly flagged on the RCBE and could be considered an administrative offence, with fines ranging from EUR 1,000 to EUR 50,000.
